Ripple presentará una apelación civil Formulario C para aclarar sus argumentos contra la posición de la SEC hoy. La presentación detallará los aspectos del fallo judicial del 7 de agosto que Ripple está impugnando, particularmente en lo que respecta a la clasificación de XRP en ventas institucionales.
Tras la sentencia final de agosto, la SEC inició una apelación contra la decisión de la jueza Analisa Torres de que las ventas de XRP por parte de Ripple en bolsas minoristas no violaban las leyes federales de valores.
La SEC pretende impugnar esa sentencia, argumentando que estas ventas deberían clasificarse como transacciones de valores. También está apelando la distribución de XRP por parte de Ripple a empleados y otras partes, así como las ofertas y ventas de XRP de los ejecutivos, que también fueron determinadas como no valores por el juez Torres.
En respuesta a la medida de la SEC, Ripple presentó una apelación cruzada ante el Tribunal de Apelaciones del Segundo Circuito de EE. UU. La contraapelación tiene como objetivo impugnar la conclusión del tribunal de que las ventas institucionales de XRP por parte de Ripple constituían ofertas de valores no registradas.
La presentación del Formulario C es una parte esencial de la estrategia legal de Ripple, ya que prepara el escenario para los argumentos que se presentarán ante el tribunal. Luego, ambas partes acordarán un calendario de reuniones informativas, lo que probablemente extenderá la batalla legal hasta el próximo año.
En una entrevista reciente con la periodista de FOX Business, Eleanor Terrett, los ejecutivos de Ripple, Brad Garlinghouse y Stuart Alderoty, expresó gran confianza al revocar la decisión de que sus ventas institucionales de XRP constituían valores no registrados.
Creen que el Segundo Circuito probablemente revocará esta decisión debido al historial del tribunal de no gustarle la extralimitación regulatoria.
“El segundo circuito tradicionalmente no es partidario de la SEC. No son fanáticos de la extralimitación regulatoria. Y estadísticamente, si pierdes, tus posibilidades de lograr que el Segundo Circuito se revierta son alrededor del 10% o menos”, dijo Alderoty. “No me gusta predecir resultados, ciertamente no garantizar resultados, pero me siento muy bien con el resultado del Segundo Circuito”.
La SEC se ha dirigido activamente a varias empresas de cifrado por la misma razón: ofrecen tokens de valores no registrados. Una victoria de Ripple en el Segundo Circuito podría reducir el alcance del regulador sobre el sector criptográfico. Sin embargo, incluso si la SEC pierde, sigue existiendo la posibilidad de que el caso llegue a la Corte Suprema.
Al abordar la posibilidad de un caso en la Corte Suprema, Garlinghouse dijo que confiaba en que Ripple ganaría y que la postura agresiva de la SEC contra la industria estaba condenada al fracaso.
“Creo que estamos en el lado correcto de la ley. Creo que estamos en el lado correcto de la historia”, afirmó.
