El 15 de octubre de 2024, Juan Tacuri, un alto promotor del esquema Ponzi de criptomonedas Forcount, fue sentenciado a 20 años de prisión federal y un año de libertad supervisada.
Al residente de Florida también se le ordenó confiscar una casa comprada con ganancias de estafa, $3,6 millones en activos y pagar una cantidad equivalente en restitución a las víctimas.
Detalles de la estafa
Documentos judiciales reveló que Forcount operaba globalmente, defraudando a miles de víctimas con un enfoque particular en las comunidades de habla hispana en los Estados Unidos. Posteriormente rebautizada como Weltsys, la estafa atrajo a inversores con falsas promesas de ganancias garantizadas a partir de la minería y el comercio de criptomonedas.
Tacuri y sus compañeros promotores atrajeron a los objetivos a invertir ofreciéndoles promesas de retornos sustanciales, incluidas afirmaciones de que sus inversiones se duplicarían en seis meses. En realidad, no se produjo ningún comercio ni minería de criptomonedas. Siguiendo el patrón típico de un esquema Ponzi, los fondos de los nuevos inversores se utilizaron para pagar a los anteriores mientras los promotores se enriquecían con el dinero de las víctimas.
El hombre de 46 años fue uno de los promotores más exitosos del plan y ganó millones de dólares. Usó el dinero para mantener un estilo de vida lujoso, comprando bienes raíces y artículos de lujo en Florida. También viajó por todo Estados Unidos, organizando llamativas exposiciones y eventos comunitarios más pequeños para atraer a más víctimas.
Los eventos fueron diseñados para generar entusiasmo, y Tacuri a menudo vestía ropa de diseñador para reforzar la ilusión de riqueza. También instó a los asistentes a invertir, alardeando de su éxito financiero y presentando los productos de inversión de Forcount como una forma de lograr la libertad financiera.
Excusas y fichas falsas
Las víctimas podían rastrear sus supuestas ganancias a través de un portal en línea falso, pero la mayoría no podía retirar ninguno de sus fondos. Como resultado, las quejas comenzaron a surgir ya en 2018. Sin embargo, Tacuri y otros promotores respondieron con excusas, retrasos y tarifas ocultas.
Para mantener el plan en marcha, Forcount comenzó a ofrecer tokens criptográficos propietarios sin valor conocidos como “Mindexcoin”, alegando que eventualmente aumentarían de valor. Estos tokens sólo provocaron más pérdidas financieras para los inversores.
En 2021, el plan había colapsado, dejando a la mayoría de las víctimas sin ningún retorno de sus inversiones. Más de 20 de ellos proporcionaron declaraciones de impacto durante la sentencia de Tacuri.
El Departamento de Justicia de Estados Unidos acusó al hombre de 47 años en diciembre de 2022, junto con sus asociadas Francisley Da Silva y Antonia Pérez Hernández. Silva y Tacuri enfrentaron cargos adicionales de conspiración para cometer lavado de dinero.
Se declaró culpable en junio de 2024 ante la jueza de distrito estadounidense Annalisa Torres, famosa por su fallo de 2023 sobre las ventas programáticas de XRP, y ha estado esperando sentencia desde entonces.
