Sin embargo, los desafíos regulatorios para Silvergate no han cesado por completo. Si bien es posible que la Reserva Federal esté dando un paso atrás con respecto a la entidad bancaria, la SEC todavía tiene una demanda en curso contra esta última por presunta complicidad con el fraude de FTX.
De la agitación al colapso
La caída en desgracia de Silvergate comenzó en marzo de 2023, en medio de la agitación más amplia del mercado de cifrado provocada por el colapso de FTX. Silvergate, que alguna vez fue la piedra angular de la criptobanca, se encontró en una situación desesperada. En febrero de 2023, sus acciones se convirtieron en las segundas más vendidas en Wall Street, con el 72% de las acciones. prestado para posiciones cortas. Ahora, la SEC se ha lanzado al ruedo con una demanda que pinta un panorama condenatorio de las prácticas de Silvergate. El regulador alega que Silvergate defraudó a los inversores al tergiversar sus controles contra el lavado de dinero y engañarlos sobre el impacto del colapso de FTX.

Según la denuncia de la SEC, Silvergate no supervisó adecuadamente aproximadamente 1 billón de dólares en transacciones y pasó por alto casi 9 mil millones de dólares en transferencias sospechosas por parte de entidades FTX. El director ejecutivo Alan Lane y la directora de riesgos Kathleen Fraher también llegaron a un acuerdo por 1 millón de dólares y 250.000 dólares respectivamente. Pero la historia no termina ahí.
Las acusaciones de la SEC se extienden a la alta dirección de Silvergate, con el director financiero Antonio Martino acusado de participar en un plan fraudulento para engañar a los inversores sobre la terrible situación financiera del banco. El bando de Martino ha negado con vehemencia estas acusaciones, preparando el terreno para un posible enfrentamiento en los tribunales.
En el centro de la controversia está la red SEN de Silvergate, alguna vez promocionada como la joya de la corona del banco.
