Grant Colthup, ex director ejecutivo de ACCE Australia, se enfrenta a un único cargo de fraude tras una investigación de la Comisión Australiana de Valores e Inversiones (ASIC).
Colthup, que compareció ante el Tribunal de Magistrados de Ipswich, Queensland, fue acusado de malversación de 1,47 millones de dólares (2,2 millones de dólares australianos) de un cliente.

Desde mayo de 2019 hasta septiembre de 2022, ACCE administró una plataforma de intercambio de activos digitales que brindaba servicios de comercio de criptomonedas a clientes bajo la marca “Mine Digital”.
Según una prensa liberarel incidente se remonta a julio de 2022, cuando un cliente pagó a la empresa 1,5 millones de dólares para comprar Bitcoin pero nunca recibió la criptomoneda.
ASIC alega que en lugar de entregar Bitcoin, Colthup utilizó los fondos del cliente para cubrir las obligaciones financieras de ACCE y comprar criptomonedas para otros clientes.
El cargo, presentado bajo la Sección 408C del Código Penal de Queensland de 1899, conlleva una pena máxima de 20 años de prisión. El caso ha sido aplazado hasta el 16 de diciembre de 2024 y será procesado por la Fiscalía.
Los problemas legales de ACCE
Este desarrollo legal es solo una de las muchas controversias que han afectado a ACCE y Mine Digital. La empresa colapsó en septiembre de 2022, lo que dejó a los acreedores luchando por recuperar aproximadamente 16 millones de dólares en fondos adeudados.
El colapso del intercambio con sede en Queensland fue entregado al administrador Brad Tonks de PKF en septiembre de 2022, pocas semanas antes de la infame caída del intercambio con sede en EE. UU., FTX.
En ese momento, una publicación local, la Australian Financial Review, reportado que las investigaciones posteriores de Tonks sobre la empresa habían sacado a la luz discrepancias financieras preocupantes, incluidos registros limitados, un balance irregular y la existencia de sólo 20.000 dólares en activos.
En una declaración a los acreedores, el socio de PKF señaló que parecía que se habían transferido importantes activos digitales fuera de ACCE antes de la administración, sin registros suficientes disponibles para rastrear las transacciones.
“Las inversiones realizadas por clientes en activos digitales no parecen haberse registrado en el balance de la empresa”, informó Tonks.
Además, el colapso se produjo poco después de una disputa legal con un fondo de jubilación autogestionado en relación con una pérdida de inversión separada de 1,6 millones de dólares en 2020. presunto que ACCE no tomó las medidas adecuadas para prevenir una estafa de ingeniería social conocida como “500 Investments”.
Aunque el intercambio se defendió en este caso, el incidente contribuyó a sus crecientes desafíos legales.
En diciembre de 2022, PKF había sido designado liquidador oficial de ACCE y Tonks inició un proceso legal contra Colthup para recuperar los 16 millones de dólares adeudados a los acreedores.
