La Cámara de Representantes de Pensilvania aprobó un proyecto de ley el 24 de octubre para establecer claridad regulatoria para activos digitales como Bitcoin (BTC) dentro del estado.
Conocida como Proyecto de Ley 2481 de la Cámara de Representantes, o proyecto de ley de “Derechos de Bitcoin”, la legislación fue aprobada con un fuerte apoyo bipartidista y recibió una votación de 176 a 26, incluidos los 100 republicanos y 76 demócratas.
Claridad regulatoria
Según Fox Business informela legislación busca proteger los derechos de los residentes de Pensilvania a poseer y usar Bitcoin al tiempo que establece pautas claras sobre la tributación de las transacciones de activos digitales.
El proyecto de ley pasa ahora al Senado de Pensilvania, liderado por los republicanos, que se espera que lo revise después de las elecciones de noviembre. Si el gobernador Josh Shapiro lo aprueba y firma, Pensilvania se unirá a otros estados para establecer sus reglas sobre activos digitales en medio de la incertidumbre regulatoria federal.
El Proyecto de Ley 2481 de la Cámara de Representantes se desarrolló con el aporte de la organización de defensa de Bitcoin Satoshi Action Fund (SAF). La SAF ha participado en esfuerzos similares en 20 estados, y cuatro proyectos de ley se convirtieron en ley en Oklahoma, Luisiana, Montana y Arkansas.
El impulso para una nueva legislación en el área se produce en medio de la incertidumbre federal sobre la regulación de los activos digitales, con agencias divididas en cuanto a la supervisión. La Comisión de Bolsa y Valores (SEC) continúa evaluando si ciertos activos digitales, además de Bitcoin y Ethereum, califican como valores. Mientras tanto, la Comisión de Comercio de Futuros de Materias Primas (CFTC) supervisa aquellos clasificados como materias primas.
“En tiempos tan polarizados, es fantástico ver a ambos lados del pasillo unirse para promover la innovación y priorizar la seguridad de los residentes de Pensilvania que poseen y realizan transacciones con criptomonedas”, dijo el representante estatal republicano de Pensilvania, Mike Cabell, patrocinador del proyecto de ley.

Con aproximadamente 1,5 millones de residentes, alrededor del 12% de la población del estado, que ahora poseen activos digitales, Pensilvania se ha convertido en un punto central en el debate nacional sobre la regulación de las criptomonedas.
El momento de la aprobación del proyecto de ley también podría tener implicaciones para las próximas elecciones del estado, ya que ambos partidos se centran en la creciente influencia de los votantes favorables a las criptomonedas.
Los legisladores creen que políticas claras sobre activos digitales podrían influir en los votantes en la carrera por el Senado entre el actual demócrata Bob Casey y el retador republicano Dave McCormick.
“Con el proyecto de ley ya aprobado en la Cámara de Pensilvania y a punto de ser aprobado en el Senado, se presenta como una cuestión fundamental para los candidatos y votantes”, dijo el fundador de SAF, Dennis Porter. Añadió que los propietarios de activos digitales representan “un bloque de votantes en crecimiento”.
Además, las políticas favorables a las criptomonedas están ganando atención a medida que se intensifica la carrera presidencial entre la demócrata Kamala Harris y el republicano Donald Trump.
