Los contratos inteligentes, los programas automatizados por blockchain, ahora son legales en Argentina luego de que la jurisdicción local reconociera la aplicabilidad del primero. Ahora se pueden utilizar para ejecutar acuerdos de alquiler, pagos de compra y otros contratos legales, ya que la criptomoneda ahora está aprobada para su uso como pago en contratos comerciales en el país.
Los contratos inteligentes alcanzan un estatus legalmente exigible en Argentina
Los contratos inteligentes, el equivalente a los contratos en papel basados en blockchain y ejecutados automáticamente, han alcanzado un hito en Argentina. Según informes locales, el primer contrato inteligente basado en Cardano fue aprobado como legalmente vinculante por la jurisdicción argentina, lo que podría ser la primera vez que esto sucede en el país e incluso en el mundo.
El contrato especifica un préstamo a cuatro meses reembolsado con un interés del 10% entre Mauro Andreoli y Lucas Macchia, dos embajadores de Cardano en Argentina. El préstamo se emitió por 10.000 ADA (cerca de 3.430 dólares). Andreoli afirmó que, en la práctica, esta formalización del contrato significa que “cualquier incumplimiento puede ser exigible judicialmente para el cumplimiento de la obligación en ADA”.
Sin embargo, debido a la naturaleza digital de los contratos inteligentes, el dúo tuvo que firmar un documento legal como complemento. Este documento especifica los detalles del préstamo suscrito por contrato inteligente, la cadena de bloques en la que se creó y las direcciones de billetera involucradas con el ID de la transacción. Como es la primera vez que esto sucede, este tipo de documento también podría ser necesario en otros casos para legalizar contratos inteligentes.
Andreoli destacó la relevancia del evento. Él afirmó:
Lo logramos, acabamos de firmar el primer contrato jurídica y judicialmente vinculante sobre la red Cardano, en pleno cumplimiento de las leyes de la República Argentina.
Andreoli cree que la criptocomunidad tiene que trabajar para educar a los jueces nacionales para que se acostumbren a este nuevo tipo de contrato, destacando que este evento marcó “la fase inicial de creación de jurisprudencia favorable en el país y facilitación de transacciones comerciales”.
Los contratos inteligentes están respaldados por el Proyecto de Ley Ómnibus del presidente Milei, que legalizó el uso de bitcoin y otras criptomonedas como parte de contratos comerciales en Argentina. Andreoli concluyó que los contratos inteligentes ahora se pueden utilizar para formalizar acuerdos de alquiler o compra y otros contratos legales.
