La Comisión de Bolsa y Valores de Estados Unidos (SEC) se ha enfrentado a una segunda disputa esta semana. El jueves, Bitnomial, bolsa de derivados de activos digitales con sede en Chicago dicho había presentado una demanda contra la SEC por afirmar que los futuros de XRP son “futuros de valores” bajo su jurisdicción.
Bitnomial, regulada por la Comisión de Comercio de Futuros de Productos Básicos (CFTC), había autocertificado el Contrato de futuros de dólar estadounidense XRP en agosto, tras la sentencia final en la demanda SEC vs. Ripple.
En otras palabras, la bolsa había declarado que su producto de futuros XRP cumple con ciertos estándares y requisitos reglamentarios según las leyes de productos básicos y podría cotizar y negociar el contrato sin la aprobación previa explícita de la CFTC.
La SEC intervino en el proceso y se puso en contacto con la bolsa poco después de la presentación. La agencia afirmó que los futuros XRP son “futuros de seguridad”, sujetos a la jurisdicción conjunta de la SEC y la CFTC. Advirtieron a Bitnomial que continuar con la cotización violaría las leyes federales de valores.
La SEC también estipuló que Bitnomial debe cumplir requisitos adicionales, incluido el registro como bolsa de valores nacional, antes de cotizar futuros de XRP.
Bitnomial está demandando a la SEC para impugnar su declaración de que XRP es un valor. Argumentan que sus contratos de futuros no deberían estar regulados por la SEC.
“Bitnomial no está de acuerdo con la opinión de la SEC de que XRP es un contrato de inversión y, por lo tanto, un valor, y que los futuros de XRP son, por lo tanto, futuros de valores”, dijo la compañía en su demanda.
Luke Hoersten, director ejecutivo de Bitnomial, dijo que el historial limpio del intercambio y la naturaleza única de su demanda contra la SEC fortalecieron su posición para presionar por un fallo judicial. Cree que el caso sentaría un precedente legal sobre cómo deberían regularse en los EE. UU. los derivados criptográficos, como los contratos de futuros de XRP.
La demanda de Bitnomial se produce poco después de que Crypto.com, uno de los intercambios de cifrado más grandes del mundo, iniciara una acción legal contra el principal organismo de control financiero de EE. UU. tras recibir un aviso de Wells.
Según Crypto.com, la SEC se ha excedido en su autoridad legal al regular los criptoactivos. La compañía argumentó que la clasificación de la agencia de casi todas las transacciones criptográficas como valores es inconsistente e ilegal.
Desde el año pasado, la industria de la criptografía ha estado lidiando con continuas acciones de cumplimiento y amenazas legales por parte de la SEC. La lista de empresas bajo el radar de la SEC se ha ido acumulando, y ahora incluye a Consensys, Uniswap Labs, Crypto.com y OpenSea, por nombrar algunas.
Ripple Labs, Binance y Coinbase son tres importantes empresas de cifrado que están involucradas en la batalla legal con la SEC en este momento. Es poco probable que estos casos se resuelvan pronto.
El jueves, Ripple anunció que había presentado un aviso de apelación para impugnar la última apelación de la SEC. Ambas partes se reconciliarán en los tribunales y pelearán en los tribunales; El equipo de Ripple dijo que está listo para luchar nuevamente y ganar nuevamente.
En julio pasado, la jueza Analisa Torres del Distrito Sur de Nueva York, que supervisó el caso SEC vs. Ripple durante los últimos tres años, dictaminó que las ventas de XRP de Ripple en bolsas no constituían transacciones de valores, mientras que las ventas a inversores institucionales sí lo eran.
Tras el fallo judicial, el 7 de agosto de este año, se ordenó a Ripple Labs pagar 125 millones de dólares para resolver la demanda de un año, insinuando la posibilidad de cerrar el caso si la SEC no procedía con una apelación.
Tanto Ripple como la SEC declararon que habían obtenido victorias, o victorias parciales, en el caso, pero la SEC siguió buscando remedios de Ripple en forma de grandes multas y ahora una apelación para impugnar el fallo judicial.
El desacuerdo sobre la clasificación de XRP continúa y es probable que estas acciones prolonguen la batalla legal hasta el próximo año.
