El FBI creó su propio token, NexFundAI, para exponer a los actores fraudulentos en el mercado de las criptomonedas. Como resultado, los fiscales estadounidenses en Boston han cargado 18 personas y entidades, incluidas cuatro importantes empresas de cifrado (Gotbit, ZM Quant, CLS Global y MyTrade) en un proceso penal por manipulación del mercado.
Los cargos se derivan de un fraude generalizado que implica manipulación del mercado y “negocios de lavado” diseñados para engañar a los inversores e inflar los valores de las criptomonedas. Trabajando en secreto, el FBI lanzó el token para atraer los servicios de las empresas acusadas, que supuestamente se especializaban en inflar los volúmenes y precios de las operaciones con fines de lucro.
“El FBI tomó la medida sin precedentes de crear su propio token y compañía para identificar, desbaratar y llevar a estos presuntos estafadores ante la justicia”, dijo Jodi Cohen, agente especial a cargo de la división de Boston del FBI.
Los cargos cubren un amplio esquema de comercio de lavado, donde los acusados inflaron artificialmente el valor de más de 60 tokens, incluido el Saitama Token, que en su punto máximo alcanzó una capitalización de mercado de $7.5 mil millones.
Se alega que los conspiradores hicieron afirmaciones falsas sobre los tokens y utilizaron tácticas engañosas para engañar a los inversores. Después de aumentar artificialmente los precios de los tokens, retirarían dinero de estos valores inflados, defraudando a los inversores en un esquema clásico de “pump and dump”.
Las empresas de cifrado también supuestamente contrataron a creadores de mercado como ZM Quant y Gotbit para llevar a cabo estas operaciones de lavado. Estas empresas ejecutarían operaciones falsas utilizando múltiples billeteras, ocultando la verdadera naturaleza de la actividad y creando un volumen de operaciones falso para que los tokens parecieran más atractivos para los inversores.
Un empleado de ZM Quant describió la práctica como una forma de “hacer que otros compradores pierdan dinero para obtener ganancias”.
Las autoridades han incautado más de 25 millones de dólares en criptomonedas y han desactivado múltiples robots comerciales responsables de millones en operaciones de lavado. Varios acusados ya se declararon culpables o aceptaron hacerlo, mientras que otros fueron detenidos en Estados Unidos, Reino Unido y Portugal.
El fiscal federal adjunto, Joshua Levy, enfatizó que el comercio de lavado ha estado prohibido durante mucho tiempo en los mercados financieros tradicionales, y las mismas reglas ahora se aplican a la industria de las criptomonedas. Esta operación, denominada “Operación Espejos de tokens”, representa un paso importante en la lucha contra el fraude en el espacio de activos digitales en rápida expansión.
Los acusados, que se presumen inocentes hasta que se demuestre lo contrario, se enfrentan a penas severas, que incluyen hasta 20 años de prisión por cargos de manipulación del mercado y fraude electrónico. El caso sirve como un claro recordatorio de los riesgos en el mercado de las criptomonedas y la importancia de la debida diligencia al invertir en activos digitales.
